The situation

The closure of a large municipal waste processing facility is an exceptionally rare event in Poland. There is no established case law or developed administrative practice in this area. The client, the operator of one of the larger facilities of this type in Poland needed a comprehensive regulatory pathway to safely and lawfully decommission the installation, without exposing itself to allegations of breaching environmental requirements or permit conditions.

Our role

We advised on the full regulatory process involved in designing and implementing an environmentally sound and fully compliant closure procedure for the facility. We developed a regulatory strategy covering integrated permit proceedings, closure documentation, and communications with the administrative authorities.

The result

The matter is ongoing, but it is already setting standards for the closure of this type of installation in Poland, in an area where the law provides no ready answers and the administrative authority had no prior experience with a comparable case.
