The situation
A company was planning a new investment in Poland. The administrative authority issued a negative environmental decision. The client came to us at a critical stage, with only 10 days before the appeal deadline.
Our role
Within 10 days we prepared and filed a comprehensive appeal, identifying specific procedural and substantive errors in the authority’s environmental impact assessment. The Self-Government Appeals Board (SKO) fully upheld the appeal and overturned the negative decision.
The result
The investment can proceed. The case illustrates one of the key principles we follow: in environmental proceedings, response time is critical and well-constructed arguments filed at the right moment can reverse even an unfavourable administrative decision.
