The situation
PFAS – per- and polyfluoroalkyl substances, known as “forever chemicals” – are at the centre of one of the largest regulatory waves in the history of EU chemical law. Manufacturers that use PFAS in their processes or products now face a dual risk: on one side, growing REACH restrictions and national environmental regulations; on the other, pressure from regulators and supervisory authorities ready to initiate proceedings or order the closure of installations. A chemical sector manufacturer whose plant emits PFAS to air faced intensified surveillance from Belgian environmental authorities.
Our role
We provide strategic advice on PFAS air emissions from the client’s production facility in Belgium. We pursue a regulatory strategy before the Belgian environmental authorities, advising on green compliance and environmental risk assessment. We act cross-border, coordinating the Polish and Belgian perspectives, which is essential in matters where national regulations overlap with the EU REACH framework.
The result
It is one of the few cases in our practice where we advise on a PFAS regulatory crisis directly before the national authorities of an EU member state other than Poland. This illustrates the breadth of our expertise: we understand EU chemical regulations not only from a Polish market perspective, but as a comprehensive system affecting operations across Europe.
