One of Poland’s largest infrastructure investments, environmental advisory on a cross-border environmental impact assessment

The situation

One of the largest and most strategically significant infrastructure projects in Poland required obtaining an environmental decision in an exceptionally complex legal environment. The case involved transboundary marine environmental impacts – an area where Polish case law and administrative practice had been almost entirely absent until then. The formal applicant was another entity, but our client, as a consortium participant, had distinct legal and regulatory interests that required protection throughout the proceedings.

Our role

We acted as the client’s environmental and regulatory counsel within the consortium. We represented the client’s interests, clarified complex procedural issues, and managed the legal risks arising from the transboundary assessment of marine environmental impacts.

The result

The project is progressing. The case is precedent-setting on the Polish market, one of the first in which transboundary marine environmental impact became the central element of an EIA procedure.
