Securing an integrated permit despite an active NGO campaign and dozens of parallel proceedings

The situation

A manufacturing plant that had been operating lawfully in Poland for many years became the target of a coordinated campaign by environmental organisations and local opposition groups. Multiple parallel administrative and court proceedings were initiated, all aimed at a single goal: blocking the plant’s right to operate. At the same time, the client needed to obtain an integrated permit (IPPC), without which continuation of operations would have been impossible.

Our role

We took over the conduct of all administrative and court proceedings relating to the client’s operations, including proceedings before the environmental inspectorate. In parallel, we ran the full integrated permit procedure, managing the risk of delays caused by the environmental organisations’ activity at every stage. We coordinated communications with the authorities and built the legal arguments to counter successive challenges.

The result

The integrated permit was obtained. The plant continues to operate without interruption. Securing this critical decision under conditions of active opposition and numerous parallel proceedings is one of the most demanding achievements in our practice and the clearest illustration of what investment process security means in practice.
