Several hundred thousand PLN saved – court overturns unlawful administrative order to carry out a costly expert water law assessment

The situation

A manufacturing plant was involved in a long-running project concerning historical soil and groundwater contamination. During the proceedings, the environmental authorities imposed an obligation to carry out a costly expert assessment valued at several hundred thousand PLN. The decision had no factual or legal basis, it was an attempt to transfer obligations onto the client that the authorities could not legally justify.

Our role

We challenged the decision before the Provincial Administrative Court (WSA) in Warsaw. We demonstrated that the environmental authorities had no factual or legal basis for imposing such an obligation. The court agreed and overturned the contested decision.

The result

The client avoided several hundred thousand PLN in unjustified costs. The case demonstrates that administrative decisions, even those issued by specialist environmental authorities can and must be effectively challenged when they exceed the authority’s legal powers.
